Allocated Lands for Tourism


No. 4957 amended by Law No. 2634 Tourism Incentive Law and the regulations issued on the basis of Article 8 of the "Regulations for Public Immovable Allocation for Tourism Investments" to invest in accordance with the provisions for tourism;

  • To the local entrepreneurs and
  • allocation to foreign entrepreneurs prepared to considered as immovable

The information inside "Tourism Public Immovable Allocation Specification Investor”, the Official Newspaper, the national three major newspapers and the Ministry of Culture and Tourism 'in the web pages, is published publicly disclosed.

In the light of the information obtained from the Culture and Tourism Ministry,

  • With the documents and information requested with "Tourism Public Immovable Investor Allocation Specification" in time, the applications to the Culture and Tourism Ministry are evaluated both in terms of financial capacity and experience of sectors under the indicated provisions of Allocation Specification and in the 11th article of "Regulations for Public Immovable Allocation for Tourism Investments".
  • Among the qualified entrepreneurs for the parcels which are applied for multiple times, negotiations are made with the aim of participation with social and technical background. In this case, it can be requested from the entrepreneur according to the quality of the region and project that the region where the investment will be accrued and the amount of portion which will be indicated by the Negotiation Commission of the participation of social and technical background.
  • The assurance requested from the Culture and Tourism Ministry should be given as Turkish Lira or cash or as definite and unlimited letter of guarantee. The entrepreneurs who are not given prior authorization should return the negotiation assurance to the Culture and Tourism Ministry.

First of all it is necessary for entrepreneurs who want to make tourism investment to know the following terms.

Cultural and Tourism preservation and development regions

Preserving the regions that are intense on historic and cultural values or have high touristic potential, using, and to provide sectoral development and the planned development, the regions that are detected and declared by the decision of Council Of Ministers and their boundaries are suggested by the Ministry of Culture And Tourism.

Tourism Centers

Tourism centers which are in preservation and development of culture and tourism in the region or abroad, firstly anticipated to be developed refer to the regions and its parts which are important in terms of touristic moves and activities that are detected and declared by the decision of Council Of Ministers and their location, boundaries and territories are suggested by the Ministry of Culture And Tourism.

Sub-Region of Culture and Tourism Conservation and Development        

The sub- regions that can be decomposed to sub-areas within itself, tourism types and culture, education, entertainment, trade, residence, covering all types of one or more of the technical and social infrastructure 1/25.ooo or determined in lower scales plan.

Tourism Management

The managements that are commercial managements which operates in tourism facilities Turkish or foreign, natural or legal persons, jointly or separately held.

Tourism Facility

Located in tourism investment or tourism facilities where the business activities and are an integral part with their details.

Tourism Document

The document refers to tourism investment certificate, the main tourism investment certificate, the tourism business document or partial document tourism businesses.

Tourism Investment Document

The document that is given during the investment for the facility whose qualities are mentioned in the regulation by the Culture and Tourism Ministry.

Tourism Management Document

The document issued by the Ministry for the facility whose operational phase of regulation qualifications specified.

Partial Tourism Management Document

The document whose Regulation qualifications specified for the type and made mandatory units required by the class facility, issued by the Ministry with other units covered by investment to be made.

Development Plans

The plans aim to provide protection and development in the touristic regions in tourism sector in the Culture and Tourism Conservation and Development Regions and Tourism Centers in behalf of ecological and economic efficiency and sustainable tourism policy, and they are physical plans at various scales defined in the regulations prepared upon determining the spatial strategies with long or short term principles and targets.

Determination of Investment Type

An investment that will be done to take advantage of the incentives provided to the tourism sector and especially to make a profitable investment in tourism aimed at foreign tourism must be documented by the Culture and Tourism Ministry.

After Deciding on the type of investment; selecting the Place of Investments:

Especially for a tourism investment, investment plays a great role.

Choosing the accurate location for investment directly affects the profitability of the investment. There are different options for the location of the investment.

Your Own Land

You will accrue the investment in your own land.

First of all it is necessary for you to learn the situation of your land in terms of the development plans. This information may be obtained by,

  • Municipalities and the municipalities in contiguous area borders,
  • Except the boundaries of the Municipal and the adjacent areas, it can be also obtained from Provincial Directorate of Public Works and Settlement.

No matter in what scale it is, it is not possible to build a tourism facility in the areas that are not reserved for the touristic utilization in the development plans. If your land is not in any boundary of a plan, first of all, it is obligatory to create a development plan which will provide the fulfilment of a tourism investment.

FOR THIS:

If your land is inside of a Culture and Tourism Conservation and Development Area and a Tourism Center, it is necessary to start the study of planning as a part of “Regulation on the Preparation and Approval of the Development Plans in Culture and Tourism Conservation and Development Regions and Tourism Centers” (to learn if your land is inside of a Culture and Tourism Conservation And Development Area and a Tourism Center officially, first of all, in order to learn the location of your land 1/25000, including any scale plans or in the present time you may mark it on and it is necessary for you to send a formal letter to our Ministry which must include your demand.)

If your land does not remain in any of Culture and Tourism Conservation and Development Area of land and the tourist center, it is necessary that by the other current legislation governing transactions must be carried out.

For these transactions, it is beneficial to take views by contacting the General Directorate of Culture and Tourism Ministry of Investment and Enterprises.

If your land is inside of the area reserved for the utilization of tourism in the approved plan for this situation accrued with the plan that is prepared and approved by you, your area for tourism investment is ready. When the formation provisions that are given for your land in approved development plan (Area, construction area permitted number of floors or height) warn, you may start the act of doing projects.

You will buy a Land.

Purchasing a land with the purpose of tourism investment is a delicate subject that should be emphasized for the sake of investor. Since the features of lands should be convenient physically for the tourism investment and it is necessary for them to be reserved for the tourism utilization in the development plan. Location, size, transport facilities, especially foreign tourists away from the opening of the airports, the infrastructure should be available and developed of the land which will be purchased are important factors while choosing a land.

From all these angles, it is beneficial to ask for opinions by applying to General Directorate of Investment and Enterprises  with scaled map with finished sketch and available situation (and next to it, the land diameter, sketches etc.) which detects the location of the land during the process of the selection of land.

After the purchase of the land ,the things mentioned in the '' Your Land'' part will also be applicable in this section .

You are going to want the Allocation of Public Land in any KTKGB and TM .

Announcement of Tourism Centers with Culture and Tourism Protection and Development Areas

1) Culture and Tourism Conservation and Development Regions and Tourism Centers ( for definitions look for the 4957/2634 numbered Tourism Incentive Law , Article 3 ) are declared with the Culture And Tourism Ministry's proposal and the decision of the Council Of Ministers in accordance with the Regulation on Culture and the Determination of Tourism Conservation and Development Regions and Tourism Centers .

2) Culture and Tourism Ministry (General Directorate of Investment and Enterprises) , Culture and Tourism Conservation and Development Area (KTKGB) and / or Tourism Center (TM) is authorized to make the determination of the area to be announced. In this context , the observations made by the Ministry of Culture and Tourism in the country determine the places that can be declared as KTKGB or TM . In KTKGB and / or TM choice, large areas are preferred for organized tourism acts , based on property , infrastructure and enviromental issues . Alongside with the ministries detections , local authorites or firms that are in tourism sector can also suggest areas to Ministry to be made KKTB or / and TM .

In the places which will be declared KTKGB and/or TM , in order to increase the bed capacity , improve the quality of the area alongside with the travel planning for tourism , planning of the tourism acts and investmens , The Ministry has set a frame for for the offers made in this purpose .

In order to an offered KKTB or/and TM to be evaluated :

a- Areas location that has been offered must be 1/25,000 scale

b- The municipalities that are in the mentioned tourism centers , their names , jurisdiction borders to be marked

c- Forest , municipality and private property that are located in the proposed area to be measured by hectare and marked on the map

d- If possible , sending a signed and sealed copy of the repaired development plan

e- New Transportation possibilities ,

f- Bids for natural areas within the permissible limits, historical, cultural and archaeological value of the site and the potential for tourism,

g - number of the domestic and foreign tourists who visit the proposed area ,

h- Tourism centers that are close to the proposed area ,

i-  drinking water, sewerage, social (hospitals, schools, etc.) and the status of the technical infrastructure

j-  a report that indicates the tourism acts and types must be prepared .

If a Cd , photograph album or visual stuff is sent to the Ministry of Culture and Tourism , it can be reviewed by them .

Interministerial Commission; Deputy Undersecretary of the Ministry of the presidency;

•  Legal advisers,

•  Cultural Assets and Museums General Director

•  General Manager of Investment and Enterprises

•  Consists of Investment and Business General Directorates and deputy director general

Commission secretariat services are executed by Investment and Management General Directorate .

Interministerial Commission is responsible for determining the location and boundries for the Culture and Tourism Conservation and Development Area .

Culture and Tourism Conservation and Development Regions and Tourism Centers are determined according to the country's natural, historical, archaeological and socio-cultural values and marine tourism, winter, mountain, health, thermal, culture, sports, and hunting,

Ministry Inter-ministerial Commission's proposals are finalized with the approval of the Culture and Tourism Ministry . ( Regulation on the Determination of Culture and Tourism Conservation and Development Regions and Tourism Centers and property "-Article-4 )

Photo, video recording and based on research with similar visual material, the region's location, ownership status, physical and natural characteristics, technical and social infrastructure, social, cultural and economic characteristics, land use and natural and environmental data are prepared by the Ministry of Investment and Enterprises and presented to the Ministry Commission .  ( Regulation on the Determination of Culture and Tourism Conservation and Development Regions and Tourism Centers and property "-Article-5 )

Inter-ministerial Commission; Chaired by the Undersecretary of the Ministry;

• Are made up of Chief of Staff,

• The Ministry of Finance,

• Public Works and Housing Ministry,

• Ministry of Transport,

• Ministry of Agriculture and Rural Affairs,

• Environment and Forestry Ministry and the State Planning Organization represantatives .

If the ministry sees fit , it can call representatives from other public institutions or other ministries .

The Commission meets on dates determined by the Ministry and the Ministry predictions of Culture and Tourism Conservation and Development Area, and examine proposals for the location and boundaries of the Tourism Center and tdetermines a written report on the results of these meetings. The documents that contains the place marks and borders maps has been foreseen to be anounced by the Ministry of Culture and Tourism Conservation and Development Area , must be sent to the Commission members at least one month before the meeting and the meeting date must be announced .  ( Regulation on the Determination of Culture and Tourism Conservation and Development Regions and Tourism Centers and property "in -Article-7 )

The proposal about the announcement of the Culture and Tourism Conservation and Development Regions containing the Inter-ministerial Commission's views are sent to the Prime Minister for approval by the Ministry .

As determined by the Council of Ministers of Culture and Tourism Conservation and Development Regions and Tourism Centers, it shall be announced by publication in the Official Gazette.  ( Regulation on the Determination of Culture and Tourism Conservation and Development Regions and Tourism Centers and property "in -Article-8 )

Detected by the Ministers to be announced by the Board of the Official Gazette of Culture and Tourism Conservation and Development Area ,planning phase is started .

Production and Approval of Plans                                                                          

Laws and regulations related to any other than planning and approving KTKGB and TM have not been given to the Ministry of Culture and Tourism .

KTKGB and TM work plan and approval processes has been given to other institutions and organizations . On the other hand , on any planning process other than KTKGB or/and TM's , eevery demand coming from that area are supported by related institutions and organizations . It is evaluated by the Ministry of Culture and Tourism and is supported within the framework of possibilities. For this purpose; Culture and Tourism Ministry General Directorate of Investment and Enterprises and Land Allocation in the Department of Finance;

• Implementation and Monitoring Directorate is also involved with tourism in accordance with their mandate allocations.
